The Home Service Store®, Inc.'s (HSS®) Limited Express 1-Year Installation Warranty

WHAT IS COVERED BY THE WARRANTY
The independent contractor will separately warrantee that all of its work substantially conforms to the manufacturer's recommendations and follows industry standards and quality guidelines. In addition, should the independent contractor fail to honor its warranty, for a period of one (1) year from the date of substantial completion of the work, upon notice to HSS, HSS will assist in the resolution of defective work in the event the work is determined to have been performed in a manner inconsistent with industry standards. Excluded from this Limited Warranty is any defect that was apparent or ascertainable at the time of the work was completed and was not promptly reported to HSS. The customer agrees to accept a reasonable product match in the event of such a repair if the original product is no longer available. In the event additional product is needed, the customer shall supply all necessary materials, including replacement product.

WHAT IS NOT COVERED
This Limited Warranty does not cover the following items:
  • A. Damage related to subsequent alterations, misuse, or abuse of the covered items by any person;
  • B. Damage resulting from fires, storms, electrical malfunctions, accidents, floods, sub-grade moisture conditions, or acts of God;
  • C. Damage related to customer's failure to observe any instructions by the independent contractor and/or manufacturer requirements, including specific product recommendations including failure to control humidity and temperature levels within the home;
  • D. Any item furnished by the customer;
  • E. The installation of odd lots, close-outs or unwarranted product;
  • F. Damage of any kind to related to moisture;

REMEDIES AND LIMITATIONS

HOW TO OBTAIN SERVICE
If a problem with the installation develops during the warranty period, after first attempting to get the independent contractor to remedy the problem, the customer should notify The Home Service Store in writing at Attn: Customer Resolutions, The Home Service Store, 80 West Street, Suite 104, Rutland, VT 05701 of the specified problem. The written statement of the problem should include the customer's name, address, telephone numbers and a description of the nature of the problem. HSS will investigate the claim promptly. Repair work will be done during normal working hours except where a delay will cause additional damage. The customer agrees to provide access to the house and to make available during the work a responsible adult with the authority to approve the repair and sign an acceptance of a repair ticket upon completion of the repair..

SPECIFIC LEGAL RIGHTS
This Limited Warranty gives the customer specific legal rights, and the customer may also have other rights that vary from state to state.

ThHE ONLY WARRANTY GIVEN BY HSS
The customer acknowledges (a) that the customer has read and understands the Limited Warranty, and (b) that HSS has made no guarantees, warranties, understandings, or representations (nor have any been made by any representatives thereof) that are not set forth in this document.

HSS IS NOT A GENERAL CONTRACTOR NOR DOES IT PROVIDE CONTRACTING SERVICES. The independent contractor is responsible for the performance of any job or contract negotiated and entered into between the independent contractor and the customer and the fulfillment of any and all warranties agreed to with the customer.

WARRANTY VOID IF: This Limited Warranty is voided in the following circumstances (unless previously authorized by HSS): 1) The customer supplies materials; 2) The customer has alterations or adjustments made by a Contractor other than the independent contractor; or 3) the customer does not sign an authorized estimate or work order form, or 4) Payment is made directly to the independent contractor.

COMPLETE AGREEMENT: It is understood that this Agreement constitutes the entire agreement between the parties and that NO representation, whether oral or in writing, shall in any way alter the terms of this Limited Warranty. Furthermore, nothing in this Limited Warranty shall in any way restrict the right of the independent contractor to bring action against the customer for non-payment.

PAYMENTS: The HSS Limited Warranty requires that ALL PAYMENTS ARE MADE THROUGH THE HOME SERVICE STORE unless otherwise authorized by HSS. Payments can be made by check or credit card (Visa, MasterCard, Discover, or American Express), and are due and payable upon completion of the work. Payments can be made at www.trusthss.com/payments. Interest of one and one half (1 1/2) percent per month (18 percent per annum) will be charged on overdue accounts from the date of completion.

LICENSES: The Floor and Decor Installation Service is coordinated by The Home Service Store® (HSS®), with installations provided by local, independent installers. Not all products are available in all locations. Floor and Decor is licensed in Pinellas County, FL (C-10135, C-10136). In certain states or counties HSS is licensed or registered as a contractor. Those locations are: FL (17845), RI (19953), CA (800861), AZ (ROC241999), OR (183271), WA (995B9), CT (HIC 0623809), MD (MHIC No. 126816), Nassau County, NY (H1778250100), Suffolk County, NY (38568-H) and Westchester County, NY (WC-11418-H01).
